Terms of Use of the CULT Website

1. General Provisions

1.1. These Terms of Use govern the procedure for using the CULT website (hereinafter referred to as the “Website”) and the conclusion of purchase and sale agreements for Goods between the Seller and the User.

1.2. These Terms constitute a public offer (proposal) in accordance with Articles 633 and 641 of the Civil Code of Ukraine.

1.3. By concluding an agreement with the Seller, the User confirms that they have read and agree to these Terms.

1.4. If the User does not agree with these Terms, they must refrain from using the Website.

2. Terms and Definitions
Seller – [full name of the company / sole proprietor] which sells Goods through the Website.

User – any legally capable person who has registered and/or placed an order on the Website. Goods – gel polishes and other products sold by the Seller.
Acceptance – full and unconditional acceptance by the User of the terms of this offer. LiqPay Service – the payment service through which orders are paid.

3. Subject of the Agreement

3.1. The Seller undertakes to transfer into the User’s ownership the Goods ordered through the Website, and the User undertakes to accept and pay for them under the terms of this offer.

3.2. The description, characteristics, price, and delivery methods of each Good are specified in the product card on the Website.

4. Procedure for Concluding the Agreement

1. 4.1.  The purchase and sale agreement is concluded by the User accepting this offer.

2. 4.2.  Acceptance is deemed to be any of the following actions:

– placing an order on the Website;
– clicking the “Place Order” button or a similar button; – paying for the order in any way.

4.3. From the moment of acceptance, the User acquires the rights and obligations defined by these Terms.

5. Registration and Account

1. 5.1.  To place orders or access additional services, the User may create an account.

2. 5.2.  The User is responsible for the accuracy of the registration data and for maintaining the

confidentiality of their password.

5.3. The Seller shall not be liable for actions of third parties resulting from unauthorized access to the User’s account.

6. Prices and Payment Procedure

6.1. Prices for Goods are indicated on the Website in Ukrainian hryvnias, including VAT (if applicable).

6.2. The Seller has the right to change prices without prior notice; however, the price of a confirmed order shall not be changed.

6.3. Payment for orders is made online via LiqPay or other available payment methods specified on the Website.

6.4. By making a payment through LiqPay, the User agrees that the necessary payment information will be transmitted to the LiqPay service operator (JSC CB “PrivatBank”) for transaction processing.

7. Delivery of Goods

7.1. Delivery is carried out by the transport company selected by the User when placing the order.

7.2.Delivery times depend on the selected carrier and are specified during order placement. Upon receiving the parcel, the User must check its integrity and completeness. In case of any damage or discrepancies, an act must be drawn up with the carrier’s representative.

8. Return and Exchange of Goods

8.1. Returns of Goods are carried out in accordance with the Law of Ukraine “On Consumer Rights Protection.”

8.2. Cosmetic products (including gel polishes) that have been opened or show signs of use are not subject to return or exchange, except in cases of manufacturing defects.

8.3. To arrange a return, the User must contact the Seller via the contact details provided on the Website.

9. Rights and Obligations of the Parties

The User has the right to:

– use the functionality of the Website; – order Goods;
– request consultations.

The User undertakes to:

– not violate applicable legislation;
– not perform actions that may disrupt the operation of the Website; – pay for orders on time.

The Seller has the right to:

– change the assortment and prices of Goods;
– restrict the User’s access in case of violation of the Terms; – amend these Terms.

The Seller undertakes to:

– ensure the operation of the Website, except during technical maintenance; – fulfill the conditions of confirmed orders.

10. Liability

1. 10.1.  The Seller shall not be liable for delays in delivery caused by shipping services.

2. 10.2.  The Seller shall not be liable for any losses incurred by the User as a result of using or being

unable to use the Website.

10.3. All claims regarding the quality of Goods shall be considered in accordance with applicable legislation.

11. Intellectual Property

11.1. All materials on the Website are the intellectual property of the Seller or respective rights holders.

11.2. Use of any materials without the Seller’s written consent is prohibited.

12. Confidentiality

12.1. Users’ personal data are processed in accordance with the Privacy Policy, which forms an integral part of these Terms.

13. Dispute Resolution

1. 13.1.  All disputes shall be resolved through negotiations.

2. 13.2.  If no agreement is reached, the dispute shall be submitted to the court at the Seller’s location

in accordance with the legislation of Ukraine.

14. Final Provisions

14.1. The Seller has the right to amend these Terms at any time. The new Terms come into force upon their publication on the Website.

14.2. The fact of using the Website confirms the User’s consent to these Terms.
